"أهلاً بكم في Happy Studio من ماكدونالدز! تبين الشروط والأحكام التالية القواعد التي يلزم اتباعها عند استخدام Happy Studio.
يرجى الاطلاع على تلك الشروط والأحكام وسياسة الخصوصية الخاصة بنا قبل استخدام Happy Studio وقبل السماح لأطفالك باستخدامه.

.2 الدخول إلى Happy Studio
"يعني استخدام تطبيق Happy Studio موافقتك على الامتثال لتلك الشروط والأحكام، لكن في حالة عدم موافقتك على أيٍ من تلك الشروط والأحكام، يرجى عدم استخدام التطبيق ومنع طفلك من استخدامه أيضًا.
فالهدف من استخدام تطبيق Happy Studio هو تحقيق المتعة لك ولطفلك. كما يحظر عليك استخدامه للترويج لأعمال خاصة أو لأية أغراض تجارية أخرى."
.3 حقوق الملكية الفكرية
تمنح حقوق الملكية الفكرية المعروفة باسم IPRs الأشخاص الحق في حماية ما ابتكروه من اختراعات وكتب وأعمال وفنون ورموز وأسماء وصور وتصاميم. وبذلك تكون جميع الصور والشعارات والرسوم التوضيحية ومقاطع الصوت ومقاطع الفيديو والنصوص وغيرها من العناصر التي تراها في تطبيق Happy Studio وكذلك التصميم العام للموقع محمية بموجب حقوق الملكية الفكرية. وتمتلك ماكدونالدز حقوق الملكية الفكرية أو لديها تصريحًا باستخدامها من جهة أخرى. وهذا يعني أنه يحظر نسخ أو إعادة إنتاج أو تغيير أو بيع أو منح الغير أي من محتويات تطبيق Happy Studio دون الحصول على تصريح أولاً من ماكدونالدز، وتُعتبر مخالفة ذلك انتهاكًا لحقوق الملكية الفكرية، الأمر الذي قد يُعرضك للمساءلة القانونية!
.4 هل يحتاج الأطفال للحصول على إذن الوالدين أو ولي الأمر لاستخدام Happy Studio؟

.5 هل Happy Studio ملائم للأطفال؟
"لا يتطلب استخدام تطبيق Happy Studio بعد تنزيله على الجهاز المحمول أو الكمبيوتر اللوحي حصول الطفل على إذن من الأب أو ولي الأمر، إذ يوفر كلً من iTunes وGoogle Play الرقابة الأبوية ودعم إدخال كلمة المرور، مما يسمح للوالدين بمنع الطفل من تحميل التطبيق.

يوجه موقع Happy Studio الطفل لسؤال والديه قبل زيارة الموقع، حيث يتطلب الدخول إلى الموقع إتمام عملية حسابية سهلة قبل الدخول إليه، ما يضمن معرفة ولي الأمر وموافقته."
.6 استخدام تطبيق Happy Studio
على الرغم من أننا بذلنا قصارى جهدنا لضمان التزام الجميع بتلك الشروط والأحكام، إلا أننا لا نعدكم بذلك، ففي حالة استخدام شخص ما للتطبيق بطريقة غير قانونية دون معرفتنا بذلك، فإننا إلى حد ما يسمح به القانون غير مسؤولين عن أفعال هذا الشخص أو تصرفاته.
.7 الربط بـتطبيق Happy Studio
في حالة وضعت رابط يؤدي إلى تطبيق Happy Studio من خلال موقع أو تطبيق خاص بك، فإنه يحظر عليك التعبير ضمنيًا أو الإشارة إلى أنك تنتمي لتطبيق Happy Studio بأي صورة من الصور، كما يحظر عليك الإشارة إلى تطبيق Happy Studio أو تقليد صوره بطريقة غير صحيحة أو مضللة أو التصرف بشكل غير ملائم بوجه عام. كن لطيفًا!
.8 هل يقوم التطبيق بجمع أية معلومات شخصية؟
لا يقوم التطبيق بجمع أية معلومات شخصية تخصك أو تخص طفلك. يرجى الرجوع إلى سياسة الخصوصية لدينا للاطلاع على طبيعة البيانات التي نقوم بجمعها وكيفية استخدامنا لها، إلى جانب التعرف على كيفية المحافظة على أمان وخصوصية تلك المعلومات.
.9 مسؤوليتنا تجاه استخدامك لتطبيق Happy Studio
"تطبيق Happy Studio متوافر حسب ""تواجده على حالته"" وحسب ""توفره""، وهذا يعني أننا لا نعد بأن التطبيق سيعمل دومًا دون توقف أو دون حدوث أية أخطاء. فقد يتعطل التطبيق من حين لآخر بشكل مفاجئ، أو قد نضطر إلى إيقافه لإصلاح خطأ ما.
كما أننا وفقًا للحد الذي يسمح به القانون لا نتحمل مسؤولية توقف التطبيق أو بطء تحميله أو وجود أخطاء أو أعطال أو فقدان أي من مكوناته.
كما أننا ووفقًا للحد الذي يسمح به القانون لا نتحمل أية مسؤولية بسبب أية خسارة قد يتحملها العميل وذلك بسبب (1) استخدام التطبيق بوجه عام (2) وجود خسائر غير مباشرة ناتجة عن استخدام التطبيق."
.10 الروابط أو الإعلانات الخاصة بمواقع ومنتجات وخدمات أخرى
لا يُسمح بوجود أية عروض ترويجية أو تسويقية لوجبات غذائية على تطبيق Happy Studio، فضلاً عن عدم وجود أية روابط لمواقع أو خدمات أخرى، ما سيجعل الآباء يشعرون بالاطمئنان عند استخدام أطفالهم لهذا التطبيق الآمن.
.11 هل يمكن أن تتغير هذه الشروط والأحكام؟
قد يلزم تحديث هذه الشروط والأحكام من وقت للآخر. لذا نحيطكم علما بأنه في حالة قيامنا بأية تغييرات، سننشر تلك التغييرات في قسم الإعدادات الخاص بالتطبيق وفي أي مكان نرى أهمية لوضعها فيه، بحيث يتسنى لك الاطلاع عليها؛ لذا يرجى الرجوع إلى التطبيق بصورة دورية حتى يتسنى لك الاطلاع على الشروط والأحكام الجديدة حال تغييرها.
.12 بعض الأمور العامة الأخرى

هل Happy Studio ملائم للأطفال؟
"لقد بذل فريق العمل لدينا كل جهد ممكن لضمان ملائمة Happy Studio لمتطلبات طفلك، فلن يتمكن الطفل على سبيل المثال من التواصل مباشرة مع الغير عبر Happy Studio. وهذا يعني أنه لا يمكن للأطفال كتابة رسائل، ولن يكون هناك كلمات بذيئة تستخدم للتسلط عليهم بأي حال من الأحوال؛ لذا سيشعر الأباء بالاطمئنان التام لعدم وجود طريقة تسمح بدردشة أطفالهم مع الغير أو مشاركة معلومات أو التواصل مع الغير بشكل غير لائق.
جدير بالذكر أن تطبيق Happy Studio لا يحوي أية عروض ترويجية أو وجبات غذائية، إذ يعد هذا التطبيق بمثابة بيئة صديقة للأطفال دون أية روابط خارجية."
ما طبيعة المعلومات الشخصية التي نقوم بجمعها؟
لا يقوم تطبيق وموقع Happy Studio بجمع أية معلومات شخصية عنك أو عن طفلك. قد تتضمن بعض الألعاب والأنشطة في تطبيق Happy Studio خاصية تتطلب الحصول على تصريح منك بالوصول إلى كاميرا الجهاز و/أو مكتبة الصور. لن تسمح ماكونالدز للغير بالدخول إلى أو الحصول على الصور الملتقطة بجهازك الخاص أو إلى أية صور موجودة في مكتبة الصور الخاصة بك.
هل يمكن مشاركة محتويات موجودة على تطبيق Happy Studio مع أي شخص آخر؟
لا يمكن مشاركة أية محتويات موجودة على تطبيق Happy Studio مع أي شخص آخر، إلا إذا سمحت للتطبيق بالوصول إلى الكاميرا خاصتك وتخزين الصور التي تحوي إبداعات طفلك على جهازك، وحينها يمكن لطفلك اختيار مشاركة تلك الصور مع الغير، وهي نفس الطريقة التي تتمكن من خلالها من إرسال صورة موجودة على جهازك، وعادة ما تكون هذه الوظيفة منفصلة عن وظائف تطبيق Happy Studio.
هل يمكن حذف تطبيق Happy Studio؟
يمكن حذف تطبيق Happy Studio بنفس طريقة حذف أي تطبيق آخر.
هل يوجد شيء آخر يجب أن يعرفه المستخدم حول وقت استخدام تطبيق Happy Studio؟
"عند استخدام التطبيق لأول مرة، سيسأل التطبيق بشأن منح التطبيق تصريح لما يلي:
(1) لإرسال إشعارات - وذلك لتعريفك على سبيل المثال بموعد التحديث أو وجود محتويات جديدة على التطبيق، ومع ذلك فإنك غير ملزم باستلام تلك الإشعارات، وإن قبلت ذلك، نعدك بعدم إرسال إشعارات لا حصر لها، وسيتاح لك دومًا خيار عدم استلام تلك الإشعارات على جهازك.
(2) للوصول إلى الكاميرا ومكتبة الصور - يسمح هذا الخيار بتفعيل بعض وظائف التطبيق التي تستخدم الكاميرا وخاصية المسح الضوئي مثلا، إلى جانب تمكينك من حفظ إبداعات طفلك على تطبيق Happy Studio في مكتبة الصور الخاصة بك مثلا، وسيمكنك حينها اختيار السماح بالدخول أو حظره، أما إذا اخترت عدم السماح بالدخول، فسيتم حجب بعض الوظائف نتيجة لذلك. يمكن اختيار تحديد الدخول على جهازك في أي وقت تشاء، وحتى وإن سمحت بالدخول إلى جهازك، فيجب أن تعي أن ماكونالدز لن تسمح للغير بالدخول إلى الصور الملتقطة بكاميرتك الخاصة أو إلى أية صور موجودة في مكتبة الصور الخاصة بك."
ما طبيعة المعلومات التي يتم مشاركتها مع طرف خارجي أو جمعها؟
"يتعاون Happy Studio مع شركاء آخرين لضمان أفضل أداء للموقع، حيث يقوم هؤلاء بجمع معلومات شخصية غير مميزة وتحليلها لتزويد Happy Studio بتحليلات علمية دقيقة، إذ تمنحنا تلك المعلومات القدرة على تحسين خدماتنا وتقديم محتوى ممتع مفيد، إلى جانب فهم متطلبات مستخدمي خدماتنا بشكل أفضل. في حالة قيامنا بتمرير المعلومات الشخصية الخاصة بك لأي طرف آخر، سنحرص على أمنها وخصوصيتها، حتى لا تُستغل في أغراض تسويقية خاصة بأطراف خارجية.
ويشمل ذلك وكالاتنا التسويقية التي تعمل في Happy Studio إلى جانب المحللين وموردي التطبيق الخاص بنا.

"يوجد مكانان اثنان فقط حيث يرتبط Happy Studio بمواقع أخرى، وهما:
Apple iTunes وGoogle Play: يتصل تطبيق Happy Studio بمتجر Apple iTunes App Store وGoogle Play لتوجيه المستخدمين بتنزيل تطبيقات iPhone وiPad وAndroid من إنتاج ماكدونالدز. كما سيوفر التطبيق فرصة للمستخدمين لتقييمه على واجهة المتجر التي تم تنزيل التطبيق منها، وقد يُطلب من المستخدم في بعض الأحيان تقييم التطبيق وترك تعليق، ويتطلب تنزيل أو تقييم أو التعليق على التطبيق من خلال تلك الواجهات وجود حسابات صالحة لكل واجهة حتى يتمكن من الدخول إلى المتجر.

Welcome to McDonald’s Happy Studio! These Terms and Conditions explain the rules you need to follow when you use the Happy Studio app.
Please have a read through these Terms and Conditions and our Privacy Policy before you use Happy Studio and before you allow your child to use Happy Studio.

2. Access to the Happy Studio
By using the Happy Studio app, you agree to comply with these Terms and Conditions. If you don’t agree with any part of these Terms and Conditions please don’t use Happy Studio and don’t allow your child to use Happy Studio either.
The Happy Studio app is only meant to be used by you and your child for your own personal enjoyment. You mustn’t use it in connection with any kind of business or for any other commercial purposes.
3. Intellectual Property Rights
Intellectual Property Rights (known as “IPRs”) give people the right to protect things they create like inventions, books, artwork, symbols, names, images, and designs. All the pictures, logos, illustrations, audio-clips, video-clips, text and other elements you see on Happy Studio as well as the general design of the website are protected by IPRs. McDonald’s either owns these IPRs or has permission to use them from someone else. This means you mustn’t copy, reproduce, change, sell or give away anything on Happy Studio unless we give your our permission first. If you do so you will be infringing IPRs and could get in trouble!
4. Do children need to get a parent or guardian’s permission to use Happy Studio?
The Happy Studio app does not require a parent or guardian's permission to play after the app has been installed on a mobile device or tablet. Both iTunes and Google Play provide parental controls and password support to allow a parent or guardian to prevent a child from downloading Happy Studio.

5. Using Happy Studio
While we make every effort to ensure that people follow these Terms and Conditions, we can’t promise that everyone will. If someone uses the app in a way they are not supposed to without us knowing, to the extent allowed by law, we are not responsible or liable for what that person does.
6. Linking to Happy Studio
If you provide a link to the Happy Studio app from your website or app, you mustn’t imply or suggest that you are somehow affiliated to Happy Studio and you mustn’t refer to or portray Happy Studio in an untrue, misleading, offensive or generally nasty manner. Be nice!
7. Do we collect any personal information?
We do not collect any personal information from you or your child. Please see our Privacy Policy which explains what information we collect, how we use it, and how we keep it safe and secure.
8. Our responsibility for your use of Happy Studio
Happy Studio is made available on an “as is” and “as available” basis. This means we don’t make any promises that the app will always be uninterrupted and/or error-free. Every now and then the app may go down by accident or we may need to take it offline to fix something.
To the extent allowed by law, we are not responsible or liable for any interruptions of the app’s availability or any delays, inaccuracies, errors, or things missing on the app.
To the extent allowed by law, we are also not responsible or liable for any loss you might suffer a) generally arising out of your use of the app, or b) as an indirect result of your use of the app.
9. Links and Adverts for other websites, products and services
There are absolutely no food promotions or food product marketing on Happy Studio. There are also no links to other websites or services so parents can be sure where their child is playing is secure.
10. Will these Terms and Conditions change?
We may need to update these Terms and Conditions from time to time. If we do make any changes, we will post the changes in the Settings section of the app and in any other areas we think necessary so that you are aware of the changes. Please make sure you look at the app frequently just in case we do make any changes to these Terms and Conditions.
11. Some other general things
These Terms and Conditions and the Privacy Policy are the only legal terms which apply between you and us regarding your use of Happy Studio.
If any bit of these Terms and Conditions is illegal, invalid or unenforceable, then that bit should be ignored and deleted and the remaining parts of these terms and conditions will remain unaffected.
These Terms and Conditions are governed by the laws of Illinois (USA).

The Happy Studio app does not require a parent or guardian's permission to play after the app has been installed on a mobile device or tablet. Both iTunes and Google Play provide parental controls and password support to allow a parent or guardian to prevent a child from downloading Happy Studio.

What personal information do we collect?
We do not collect any personal information from you or your child on the Happy Studio app and website.
Certain games or activities within the McPlay app may contain functionality requiring your permission to access your device's camera and/or photo library.
McDonald’s does not access or retrieve photos taken on your device or any photos saved within your photo library.
Can you share content from Happy Studio with anyone else?
Content from Happy Studio cannot be shared with anyone else except that, if you allow the Happy Studio app to access your camera and store photos of your child’s creations on your device, you could choose to share those photos with others, only in the same way you could send a photo on your device usually – this function is separate from and outside of the functions of the Happy Studio app.
Can you delete the Happy Studio app?
You can delete the Happy Studio app in the same way you would delete any app from your device.
Is there anything else you should know about when you use the Happy Studio app?
When you use the app for the first time, it will ask you whether you grant the app permission:
(i) To send you notifications – these are e.g. to tell you when there is an update or new content available on the app; you do not have to allow notifications but, if you do, we promise not to send an excessive number and you can choose to turn them off at any time on your device;
(ii) To access the camera’s device and photo library – this is to allow some app functionality that uses the camera e.g. scanning and to enable you to e.g. save your child’s Happy Studio creations to your photo library; you can choose whether or not to allow access but if you do not grant access, some of the functions of the app will be limited as a result. You can choose to restrict this access on your device at any time. Even if you grant access, it is important for you to understand that McDonald’s will not have access to any photos taken on your device’s camera or any existing photos in your device’s photo library.
What information is shared with or collected by Third Party Partners?
Happy Studio works with Third Party Partners to ensure optimal site performance. These partners collect, monitor and analyze non-personally identifiable information to provide Happy Studio with accurate analytics. This information allows us to improve our services, provide content of more interest to users, and better understand and serve our users. If we do give your information to anyone else we will make sure that it is kept safe and secure and is not used for the third parties’ own marketing purposes.
Our third party partners include our marketing agencies who work on Happy Studio, our analytics provider and our app provider.
We reserve the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to protect the integrity of the website and app, to fulfil your requests, or to cooperate in any law enforcement or regulatory investigation.
We may share certain “non-personal” statistical information with others to identify trends in how Happy Studio is used; for example, how many people visit Happy Studio each month. Don’t worry, this information will never identify you specifically.

Does Happy Studio link to other websites?
There are only a couple of places where Happy Studio links to other websites:
Apple iTunes and Google Play: The Happy Studio app will link to the Apple iTunes App Store and Google Play to direct users on how to download iPhone, iPad and Android applications developed by McDonald’s. The Happy Studio application will also provide the opportunity for users to rate the Happy Studio app on the storefront from which the app was downloaded. When prompted, the user will be asked to rate the app and leave a review. Downloading, rating and reviewing of any app on these storefronts require valid accounts on each storefront and for the user to be logged in to the store.
